OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. Eligibility . Subject to the additional restrictions below, The Summer of HOT Contest (the “Contest”) is open to South Carolina residents 16 years or older at the time of entry. Employees of Cox Radio, Inc. d/b/a WHZT-FM (the “Sponsor”) and its affiliated companies, advertising and promotional agencies, the participating sponsors, and the immediate family members of, and any persons domiciled with any such employees, are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.

 

3. How to Enter. The Contest begins at 12:01 a.m. (E.D.T.) on Friday, July 3, 2009 and ends at 11:59 p.m. (E.D.T.) on Saturday, August 29, 2009 (the “Giveaway Period”).   Entry deadlines may vary depending on entry method (see below for details).  Sponsor may at any time during the promotion, at its absolute discretion, terminate or suspend the Contest. All decisions made by the monitors and judges appointed by Sponsor will be final.

A maximum of one hundred ninety eight (198) entrants will have the chance to participate in the Giveaway Event for a chance to win the Grand Prize. To win the chance to participate in the Giveaway Event, you must become a “key winner” as detailed below.  There are two (2) ways to become a key winner, as follows: 

 

Listen and Win:   Entry during the “listen and win” phase of the Contest requires two steps.  First, you must register to become a member of the Freeloader club and then you must listen for your name be called on air during designated “listen and win” periods and then call back the Station, if you hear your name, as instructed below..  If you are not already a Freeloader, visit the Sponsor’s website (www.hot981.com), complete all of the required information and follow all posted instructions for becoming a member of the Freeloader club.  Provide your name, address, date of birth, gender, day and evening phone numbers and valid e-mail address. You may also become a member of the Freeloader club by completing all of the required information at a HOT 98-1 Summer of Hot event where Sponsor is present.  Limit one (1) membership in the Freeloader club per person.  Membership in the Freeloader club is free.

 

Entries must be filled out completely and legibly in order to qualify, and will be void if they are, in whole or in part, incomplete, illegible, damaged, irregular, counterfeit, altered, or obtained through theft or fraud.  No mechanically reproduced, software-generated or other automated multiple entries are permitted.  Sponsors are not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsors), human error, or any other error or malfunction.  For online entries, the authorized account holder of the e-mail address submitted at time of entry will be considered the entrant.  An “authorized account holder” shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account.  A potential winner may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry.  Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming code that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.  Any attempt to deliberately damage any web site or undermine the operation of the Contest is a violation of criminal and civil laws, and Sponsor reserve the right to seek damages from any person who makes such attempt(s).  Entry materials that have been tampered with or altered are void.  Any questions regarding the number of entries submitted by an individual or the authorized account holder of an e-mail address shall be determined by Sponsor in their sole discretion, and Sponsor reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

 

Beginning Monday, July 6, 2009 and ending Friday, August 28, 2009, each weekday (Monday-Friday) listen to Hot 98.1 at approximately 12:00 noon E.D.T., 3:00 p.m. E.D.T. and 6:00 p.m. E.D.T. for a name to be announced from among those who have registered to be a member of the Freeloader club.  The only names that will be called will be from the Freeloader club.  If your name is called on air, you have nine (9) minutes to call back the studio lines at the contest number designated in the announcement.  If you call back within nine (9) minutes, and subject to eligibility and compliance with these Official Rules, you will be a “key winner.”  Failure to call within the nine (9) minute window or failure to satisfy the eligibility requirements will result in disqualification from the Contest. Any telephone calls placed to the Sponsor call-in line may be recorded for use on air any time.  Sponsor’s timekeeping system will be the sole timekeeping system used for purposes of the Contest.

 

Sponsor will not be responsible for loss of service to the call-in line or for a contestant’s failure to reach the call-in line due to malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call.  In the event of interruption of power or telephone service to Sponsor during a call-in period of the Contest, the call-in period affected by the interruption may or may not be replayed at the resumption of service, at Sponsor’s sole discretion.

 

Register and Win:  Sponsor also will select additional key winners at designated HOT 98-1 Summer of Hot event where Sponsor is present announced by Sponsor between July 3, 2009 and August 28, 2009.  To register at a HOT 98-1 Summer of Hot event for a chance to become a key winner, fill out an official registration form or hand print on a 3” x 5” note card or piece of paper your full name, date of birth, address (including zip code), and day and evening telephone numbers (including area codes) and deposit your completed registration form or 3” x 5” card in the designated official registration box.  No mechanically reproduced entries permitted.  Limit one (1) entry per person at each HOT 98-1 Summer of Hot event.  Sponsor will select one (1) key winner from the eligible entries received at each HOT 98-1 Summer of Hot event.  Key winners will be notified by telephone, email or postal mail..  Sponsor’s inability to reach a key winner, return of any notification as undeliverable and/or a key winner’s failure to timely respond to notification may result in that key winner’s disqualification, the forfeiture of his or her interest in a key at the Giveaway Event, and the selection of a substitute key winner from among all remaining eligible entries.  In addition, Sponsor will select ten (10) event prize package winners from the eligible entries received at each HOT 98-1 Summer of Hot event.  Event prize package winners will be notified telephone, email or postal mail..  Sponsor’s inability to reach an event prize package winner, return of any notification as undeliverable and/or an event prize package winner’s failure to timely respond to notification may result in that winner’s disqualification, the forfeiture of his or her interest in all prizes, and the selection of a substitute event prize package winner from among all remaining eligible entries. 

 

Sponsor will not be responsible for any incomplete, lost, late, stolen, misdirected, illegible, garbled or unintelligible entries, or for failure to receive entries due to transmission failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, or telephone equipment, line, or network, whether originating with sender, caller, or receiver.  Any questions regarding the number of entries submitted shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.  All entries become the property of Sponsor and none will be returned.

 

Giveaway Event:  To be eligible to win the Grand Prize, key winners MUST appear and register with a Sponsor representative at the Giveaway Event on August 29, 2009 at the location announced by Sponsor during the Giveaway Period no later than the time announced by Sponsor.  Each key winner is responsible for obtaining the time and location of the Grand Prize giveaway by logging on to HOT981.com or contacting the station between 9:00 am and 5:00 pm weekdays between August 21, 2009 and August 28, 2009.  All key winners are responsible for transportation to and from the Giveaway Event.  At the Giveaway Event, each key winner must present valid government issued photo identification with proof of the key winner’s age, and must sign any statement that Sponsor may require assuring that the key winner has complied fully with these Official Rules.  Failure to attend the Giveaway Event, to present required identification, or to sign the statement of compliance with the Official Rules may result in immediate disqualification.  Each key winner must personally appear at the Event to be eligible – no proxies are permitted.  The names of all eligible key winner who have complied fully with these Official Rules, as determined by Sponsor in its sole discretion, will be added to the Giveaway drum to be eligible for a chance to win the Grand Prize.  Once the drawing begins, any key winner whose name is not in the Giveaway drum shall be deemed disqualified.  

 

After mixing up the names that have been entered in the Giveaway drum in accordance with paragraph above, a Sponsor representative will begin to randomly select names from the drum.  In the order that their names are called, eligible key winners will select a key from a drum and have the opportunity to try that key in the ignition of the Grand Prize vehicle.  The first key winner whose key starts the Grand Prize vehicle will win the Grand Prize (subject to verification of eligibility and compliance with all terms and conditions in these Official Rules).  Keys are not transferable.  In the event that each key winner selects and tries a key and no selected key starts the Grand Prize vehicle (as a result of mechanical problems or other reasons), Sponsor will randomly select one (1) key winner from among the names of all registered key winners who are present at the Giveaway event, and the selected key winner will win the Grand Prize (subject to verification of eligibility and compliance with all terms and conditions in these Official Rules).  In the event that the holder of a winning key, or any winner selected by random drawing, is disqualified, Sponsor shall determine an alternate winner by conducting a random drawing from among the names of all other registered key winners who are present at the Giveaway Event.

 

4.  Prizes and Odds:  Grand Prize:  Only one (1) Grand Prize will be awarded in the Contest.  The Grand Prize consists of one (1) 2010 Kia Soul (option package and features to be selected by Sponsor in its sole discretion) (ARV: $16,690),  one (1) gift card to Roger’s Stereo in the amount of $2,500 which can be used for store purchases, parts and/or labor but not redeemable for cash (ARV: $2,500), and any additional prizes announced on the Sponsor’s website (www.hot981.com). By entering, entrants understand and acknowledge that the Kia Soul may have incidental mileage associated with delivery and display at dealership, and Grand Prize Winner agrees to accept the Grand Prize vehicle “as is.”  Prize consists only of the item specifically listed and does not include additional options, license, insurance, title, or registration fees, or taxes. Winner must satisfy applicable proof-of-insurance laws to take delivery of prize and must take delivery of prize at the location to be determined by Sponsor in its sole discretion.  All license, insurance, title and registration fees, and federal, state and local taxes are the sole responsibility of winner. 

 

Event Prize Package:  Ten (10) event prize packages will be awarded at each 98.1 Summer of Hot event.  Each event prize package winner will receive a prize determined by Sponsor in its sole discretion (ARV: at least $10). 

 

Odds:  The odds of being selected as a key winner depend on the total number of eligible participants who enter the Contest, and upon the number of eligible participants who enter through each entry method.  The maximum estimated odds of winning the Grand Prize, once selected as an eligible key winner, are 1 in 198.  No more than one hundred ninety eight (198) people will become key winners.  The odds of winning an event prize package depend upon the number of eligible entrants.

 

5. Winner Notification and Acceptance.  Winners may waive their right to receive prizes. Prizes are non-assignable and non-transferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes, as well as license and registration fees, transportation costs, and other incidental costs incurred by participating in the. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of sender's postmark or personal delivery. Failure to timely sign and return the affidavit or release may result in a winner's disqualification, the forfeiture of his or her interest in the prize.
Failure to comply with any term or condition of these Official Rules may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Any prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of the Sponsor. 

 

Any key winners under the age of 18 must have a legal guardian present at the Giveaway Event and, in the event that a key winner under the age of 18 is the winner of the Grand Prize, to accept Grand Prize on his or her behalf.  Such legal guardian must sign an affidavit of eligibility and a liability and publicity release and will be responsible for reporting and payment of any taxes or other associated fees of the Grand Prize.  Failure of any minor to have a legal guardian sign the affidavit of eligibility and a liability and publicity release and accept the prize on behalf of the minor will result in a forfeiture.

6.  Publicity Consent.  By participating in the Contest, each key winner consents to the publication of his or her name, likeness, image, photograph, voice and/or biographical information by the Sponsors in any media, for any commercial or promotional purpose, without limitation or further compensation.  The Grand Prize winner of the Contest will be required to take part in all publicity activity associated with the promotion, including, but not limited to, phone calls, radio, TV, or press interviews, etc., for the duration of the promotion, and any time thereafter where there is publicity associated with the promotion. By participating, the Grand Prize winner agrees not to engage in any negative interviews or make any disparaging comments or statements about Sponsor, its employees or associates.  Any winner or contestant agrees to assist Sponsor in the conduct of any investigation deemed necessary or appropriate to determine the legitimacy of the contestant’s fair play.

 

7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor which shall be final in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. By participating in the Contest, winner acknowledges the Grand Prize is a 2010 Kia Soul, and he/she will be responsible for all taxes and fees associated with the prizes before taking possession.

8.  Limitation of Liability.  By entering this Contest, each entrant forever discharges and releases the Sponsor, its parent company, subsidiaries, and affiliates, and the directors, officers, employees, and agents of each of the foregoing, from any and all liability whatsoever for any claims, causes of action, suits, demands, costs, injuries, losses or damages of any kind arising from or in connection with the Contest or with the acceptance, possession or use of any prize, or travel to or from any Contest event (including, without limitation, claims, costs, injuries, losses, or damages related to: personal injury; damage to, or loss or destruction of property; rights of publicity or privacy; and defamation or portrayal in a false light).

7. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

8. Sponsor. The Summer of HOT Contest is sponsored by Cox Radio, Inc. d/b/a WHZT-FM.  The decisions of Sponsor and Contest judges regarding the selection of winners, the interpretation of these Official Rules and all other aspects of the Contest shall be final and binding in all respects. Sponsor reserves the right to modify, change or amend any and all rules and prizes to Contest without prior notification of winners, affiliates, and/or qualifiers. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
